There has been much controversy regarding the recent presidential directive redefining and expanding who might be considered a gun dealer. Many questions are being asked regarding where the line will now be drawn between casual sales and business sales. The potential for abuse is alarming!
The way I see it, the wrong questions are being asked. Let's start with: Where is the Constitutional authority for federal gun regulation? What were the thoughts of the framers of the Constitution regarding the right to bear arms?
1. Natural law dictates that freedom from tyranny and self-defense are unalienable rights. Therefore, no government can infringe upon those rights.
2. The Constitution does not authorize the federal government to regulate guns. Therefore, without explicit authorization, the issue remains within the domain of each of the several states.
3. The 2nd Amendment was written to ensure that no doubt can remain regarding the federal government's inability to regulate guns.
4. The words, "shall not be infringed" can only be found in the 2nd Amendment. Those words make it absolutely ironclad that the federal government cannot regulate guns.
5. The world's most advanced weapons of war (battleships) during the 18th and well into the 19th century (including the war of 1812) were privately owned. That fact removes any shadow of a doubt regarding an individual's unrestricted right to bear arms.
The sovereign states created the federal government via the
Constitution. Those states cautiously delegated very limited powers to the
federal government. The federal government does not have the legal authority
to expand their own power. Only Constitutional amendments can do that. Comparing
our government to the story of Frankenstein's Monster explains a lot about what

Current practice, of course, is for the federal government to ignore the Constitution and audaciously determine the boundaries, if any, of their own power. They justify this lawlessness by continuing to very creatively find new meanings to words in the Constitution that no one had ever previously imagined.
The best term for our post-constitutional republic is an oligarchy. That means that the concentration of power rests within a small group of rulers. One idea to address this problem is what I call "The Becker Doctrine."

In summary, the provisions of HB 257 include:
· Slow (state only) spending growth by $1.3 billion from HB 64 (state budget).
· Reduce income tax rates proportionally.
· Phase out income tax over five years.
· Slow "all funds" growth by $6.2 billion from HB 64.
· Eliminate Obamacare Medicaid expansion.
· Defund Planned Parenthood.
· Eliminate the Ohio Marriage Penalty.
· Allow sales tax refunds for Core charges.
· Allow Governor Kasich's proposed severance tax to apply to public lands only.
· Expand Indigent tort reform.
· Prohibit double dipping in the state pension system (grandfather in current double dippers).
